on the Elimination of All Forms of Discrimination against Women (CEDAW) has been
ratified for 32 years by Indonesian Government and adopted in the Law No.7 of
1984. Since its ratification of CEDAW, the government of Indonesia has made various
efforts for the advancement of women’s rights. For instance, passing Domestic
Violence Law No. 23 of 2004 is a milestone for the elimination of domestic
violence; enacting Presidential Decree No.9 of 2000 on Gender Mainstreaming in
National Development is an important policy strategy to mainstream gender into
national development; and stipulated Anti-Trafficking Law No. 21 of 2007 that
criminalized debt bondage, labor exploitation, sexual exploitation and
transnational and internal trafficking.
Yet discrimination against women remains, and many cases of violence
against women have occurred without receiving justice. There are a number of
obstacles and restrictions that impede women from realizing their right of
access to justice. These obstacles occur in a structural context of
discrimination and inequality, due to factors such as gender stereotyping,
discriminatory laws, intersecting discrimination and a
failure to systematically ensure that judicial mechanisms are physically,
economically, socially and culturally accessible to all women. All of these
obstacles constitute persistent violations of women’s human rights.
the General Recommendation No.30 on Access to Justice that the realization of
the rights of access to justice is essential and protected under the articles
of the Convention. The right to
access to justice is multidimensional. It encompasses justiciability,
availability, accessibility, good-quality and accountability of justice
systems, and provision of remedies for victims. By ratifying CEDAW, state
parties are obliged to ensure that women have access to justice. This
obligation encompasses the protection of women’s rights against all forms of
discrimination in a view of empowering women as individual and rights holders.
Effective access to justice optimizes the emancipatory and transformative
potential of law.

Justice Programme
focuses of UN Women (the United Nations Entity for Gender Equality and the
Empowerment of Women) working with government, civil society and various
related stakeholders. UN Women is seeking a
national consultant to; map initiative that has been developed in the area of
access to justice as well as its potential resources, develop a programming framework
and strategies to work on women’s access to justice in Indonesia. The programme that being
developed will focus on strengthening the element of
access to justice and support for a creation of an enabling environment for
access to justice for women. By recognition of the interconnectedness and

To develop programme
framework on women’s access to justice, design a strategic programme
development in the national and sub-national level, and gather baseline data to
support programme intervention. III. SCOPE OF WORKUnder direct
supervision of the National Programme Officer for Governance, the consultant
will perform the following tasks:·
Review relevant women’s access to justice law and
policy, programme evaluations and reports, and other documentation materials as
necessary including statistical data. ·
Consult with all relevant stakeholders in the national
level including the Ministry of National Development Planning, Ministry of Law
and Human Rights, Supreme Court of Indonesia, National Commission on Violence
against Women, National Human Rights Commission, and Legal Aid Organisations,
GBV services. UN Women National Programme Officer on Governance will
participate in these meetings as relevant. ·
Design framework for program intervention in the
National and Sub-National level specifically in Sulawesi Island, targeting key
government institutions, justice sector, legal aid organisation and community. This must include a theory of change, recommendations for
potential responsible parties and other partners, logframe and monitoring and
evaluation plan.·
Validate programme design with relevant stakeholders
in collaboration with UN Women. ·
Prepare guidance to inform the preparation and
implementation of the programme. ·
Gather baseline data as per the M&E framework.

IV. DURATION OF THE ASSIGNMENTThe total duration of the
contract assignment will be between 17 October and 31 December 2016. The
tentative schedule of potential mission is 7 days to Makasar, South Sulawesi for conducting mapping
and consultation as basis for developing draft strategy and programme design,
including consultation summary, theory of change, recommendations for partners,
log frame and M&E Plan and one mission for validation of the final
draft.
PAYMENT Tentative contractual period is from 17 October-31 December 2016.

Consultant with background materials for the desk review; Project document and

The consultant is
expected to work remotely using his/her own computer, but may access the UN
Women office printing or relevant documents or should he/she be required to
work on-site at any point during the assignment.

Master’s degree in law, human rights Law, public
policy, gender studies, social science or other related fields
At least 7 years of experience of relevant work in the field of access
to justice and or women’s access to justice·
Proven expertise in women’s rights and violence against women
programming, specifically related to programme design by providing applicant’s
work of result in the respected area is advantageous. ·
Proven experience in conducting formative
research on women’s human rights and VAW in the context of formal and informal
justice system by providing applicant’s work in the respected area is advantageous.·
Familiar to implement theory of change in the program
design development is a prerequisite ·
Experience working with formal justice actors
and informal justice actors would be an added advantage.
Excellent verbal and written English skill. ·
Computer literacy and ability to effectively use
office technology equipment, IT tools, ability to use Internet and email.
APPLICATION EVALUATION CRITERIA The total number of
points allocated for the technical qualification component is 100. The
technical qualification of the individual is evaluated based on following

Only the candidates who have attained a minimum of 70% of total points
will be considered as technically-qualified candidate.Financial/Price Proposal evaluation:§ Only the financial proposal of candidates who have attained a minimum of
70% score in the technical evaluation will be considered and evaluated. § The total number of points allocated for the price component is 100. § The maximum number of points will be allotted to the lowest price
proposal that is opened/ evaluated and compared among those technical qualified
candidates who have attained a minimum of 70% score in the technical
evaluation. All other price proposals will receive points in inverse proportion
