CHAI Overview

The Clinton Health Access Initiative, Inc. (CHAI) is a global health organization committed to our mission of saving lives and reducing the burden of disease in low-and middle-income countries. We work at the invitation of governments to support them and the private sector to create and sustain high-quality health systems.

CHAI was founded in 2002 in response to the HIV/AIDS epidemic with the goal of dramatically reducing the price of life-saving drugs and increasing access to these medicines in the countries with the highest burden of the disease. Over the following two decades, CHAI has expanded its focus. Today, along with HIV, we work in conjunction with our partners to prevent and treat infectious diseases such as COVID-19, malaria, tuberculosis, and hepatitis. Our work has also expanded into cancer, diabetes, hypertension, and other non-communicable diseases, and we work to accelerate the rollout of lifesaving vaccines, reduce maternal and child mortality, combat chronic malnutrition, and increase access to assistive technology. We are investing in horizontal approaches to strengthen health systems through programs in human resources for health, digital health, and health financing. With each new and innovative program, our strategy is grounded in maximizing sustainable impact at scale, ensuring that governments lead the solutions, that programs are designed to scale nationally, and learnings are shared globally.

Background

This consultancy is intended to support the Operations Team, particularly Human Resources, in understanding and complying with labor laws and regulations (undang-undang ketenagakerjaan), as well as providing legal advice and consultation related to employment matters and staff contracts.

Objective

The consultant is expected to support the Management and Operations Team by providing strategic and operational legal advice, particularly in the area of labor law. This includes but is not limited to the following:

  • Providing legal advice and input on employment-related policies and practices;
  • Reviewing and advising on staff employment contracts and agreements;
  • Ensuring all employment-related documents are in compliance with Indonesian labor laws and CHAI’s internal policies.

Scope of Work (SoW)

The consultant will be responsible for the following tasks:

  • Review existing employment contracts and HR documents to ensure compliance with prevailing labor regulations in Indonesia;
  • Provide legal opinion or written guidance related to specific employment cases or contract terms;
  • Advise on best practices for drafting or amending employment contracts, including fixed-term, volunteer, and consultant contracts;
  • Support HR in interpreting and applying labor law provisions (UU Ketenagakerjaan, UU Cipta Kerja, PP turunan, dll.);
  • Assist in developing or updating HR policies and procedures, ensuring legal compliance and organizational consistency;
  • Be available for consultations (online or in-person as needed) with HR or management related to any legal employment issue during the contract period.

Deliverables

  • Summary report of contract/document review with recommendations;
  • Draft or revised versions of employment contract templates (as needed);
  • Legal memos or opinion letters (when requested by HR);
  • Final summary report at the end of the consultancy, detailing tasks completed and key advice provided.

Timeline & Location

The consultancy will last for a period of 1 to 3 months, depending on scope and availability, starting from the signing of the contract.

The consultant may work remotely but should be available to attend in-person meetings at the CHAI Indonesia office in Jakarta if required.

Qualifications

  • Licensed lawyer or legal consultant with demonstrated experience in Indonesian labor law;
  • Minimum 5 years of relevant experience in employment law, preferably with exposure to non-profit or international organizations;
  • Proven ability to review, draft, and interpret employment contracts and labor-related policies;
  • Strong communication and advisory skills in both Bahasa Indonesia and English.
